GENERAL TERMS AND CONDITIONS OF SALE

 

GENERAL NOTES: our general terms and conditions of sale are regulated by Part III, Headline III, Chapter I of the Consumer Code (law decree no. 206/2005, as modified by legislative decree 21/2014), and in particular, by Section II: distance Contracts, and by e-commerce regulations (legislative decree 70/2003) and can be applied only to online purchasing of Courses and other Events (hereafter referred to as “Courses”) made on “www.thegoodbeersociety.it”  website (hereafter referred to as “website”).

 

These conditions are applicable exclusively if you are a “consumer”, as stated by art. 3, comma 1, letter a), of the Consumer Code.

 

Before passing any purchase order, you are required to read carefully the present Conditions, print them or archive them, and to accept them during the purchase order procedure. It is necessary, during the same procedure, to accept the Privacy Policy by flagging the dedicated box.

 

Courses are sold by Rossi&Bianchi snc, with registered office in Via Roncaglia 14 – 20146 Milan, VAT number 04396740963, registered with the Companies’ registry of Milan under no. MI 1745057; (hereafter referred to as “Rossi&Bianchi”). The purchase agreement of the online Courses is entered into with Rossi&Bianchi.

 

Courses are sold to the person identified in the electronic order form that we receive.

 

It is necessary to have reached the age of majority (18 years old) to purchase our Courses on the website.

 

These Conditions may be subject to modifications. The text of the modified Conditions will be promptly published on the website. The new Conditions published on the website will apply and will be considered agreed at the time the purchase order is passed.

 

  1. ONLINE PURCHASE ORDER PROCEDURE

 

To complete the online purchase order, you will have to access the website, fill the electronic registration form and follow the instructions in order to choose the Course and proceed with the payment.

To complete the online purchase procedure, you will have to pay the course within 5 working days.

After the payment, the order will be confirmed by a confirmation email containing the invoice, that you will receive on the email address specified on the electronic registration form.

You are required to read and control the information reported on the confirmation email and promptly report any mistake.

The contract is considered concluded  when you receive the aforesaid order confirmation email.

The order may be cancelled based on the terms and following the procedure under art. 6 hereunder.

 

  1. COURSES

 

The description of the main characteristics of our Courses is reported on www.thegoodbeersociety.it. Please refer to it for further information.

 

  1. PRICES

 

Prices are expressed in Euro and refer to the total cost of the chosen course, including taxes and any other possible cost.

The price applying at the time of the purchase order and shown on the confirmation email remains the same even if the price of the course published on the website varies.

Travel expenses  or room and board expenses are not included in Course fee.

 

  1. PAYMENT METHODS – INVOICING

 

The price of the course has to be paid within 5 working days from the purchase order, and it can be paid by means of:

The wire transfer shall report the following: enrolled person/s name/s and surname/s, course name and beginning course date and the reservation ID.

If we don’t receive any payment within 5 working days from the purchase order, the reservation request itself will be considered invalid.

 

In certain cases to be previously agreed, we accept cash payments on the beginning course date.

 

Following the payment, which is VAT included, you will receive an invoice (prepared pursuant to art. 21 Presidential Decree no. 633/1972) on the email address communicated at the time of the registration.

 

  1. CONDUCT OF COURSES

 

The number of participants is determined by Rossi&Bianchi at its sole discretion. Accordingly, the course will start only once the minimum number of participants determined by Rossi&Bianchi is achieved. The course will be held in the venue specified on the website, on the date reported on the confirmation email or on another date agreed pursuant to art. 6. In case the chosen course was not available, we will contact you to agree a new date or to propose a course different form the one requested in the purchase order. If you are not willing to wait further or to accept the proposed alternative course, you can terminate the contract in writing and we will refund all payments received related to the course within 14 days from the date of receipt of your termination notice .

 

  1. INFORMATION REGARDING THE RIGHT OF WITHDRAWAL PURSUANT TO ART.49, PARAGRAPH 4, CONSUMER CODE

 

  • Right of Withdrawal

Your right of withdrawal may be exercised, without specifying the reasons for said withdrawal, within 10 days before the beginning of the chosen course or event.

 

  • Exercise of the right of withdrawal

To meet the withdrawal term, you must send us a withdrawal notice in writing before the end of the withdrawal period.

 

  • Withdrawal effects

If you withdraw from the contract, you will be refunded all the payments that we have received, without undue delay, within 14 days from the date of receipt by our company of your withdrawal notice.

Refunds will be made through the same payment method used for your initial transaction, unless you decide otherwise; in any case, you will not be charged for the refund.

 

  • It remains understood that, if you don’t send the withdrawal notice before the end of the withdrawal period as provided for by art. 6.1, the amount paid won’t be refunded. Rossi&Bianchi reserves the right to allow the buyer to use the paid amount only to register to the same course typology starting in other dates, provided that the registration is made within the next 12 months: without any further registration the amount paid will be considered acquired and will not be reusable.

 

  1. RELEASE OF THE ATTENDANCE CERTIFICATE

At the end of the tasting and homebrewing courses, participants will be delivered an attendance certificate if they don’t exceed 2 absences. At the end of the “Beer Geek” level, participants will have to pass a final exam to become beer taster and an official lecturer of  The Good Beer Society (following a ride-along period with a senior lecturers).

You will not be released any certificate for your participation to events or beer tours.

 

  1. APPLICABLE LAW AND JURISDICTION

The present conditions are governed by Italian Law. Exclusive jurisdiction for any dispute related to the validity, the interpretation, the execution and the termination of the present contract or related thereto, is given to the Court of Milan with the exclusion of any other Justice Courturt.
